Mediation a good alternative for some divorcing couples

The process of ending a marriage can be difficult for all parties involved. The emotions that may arise as matters related to the divorce are being resolved can make the process particularly difficult.  While in some situations divorces in Alberta are contentious, they don’t always need to be.  In some cases it may be possible to pursue another route to sort out issues pertaining to the end of a marriage. Various alternative dispute methods may be used. Mediation is one of those options. 

There are multiple reasons why using mediation to divorce could be a good approach. It is usually less expensive than litigation and takes less time to complete. In addition, unlike litigation where options are limited by Alberta Rules of Court, in mediation, there is much more flexibility. This flexibility can lead to creative solutions that are agreeable to all parties involved. This may be particularly beneficial when the divorcing couple has children and will need to continue to work together to raise the children, for years to come.

Of course, parties who use mediation to divorce do not have to do it on their own. A mediator can help individuals navigate the process. The mediator is a neutral third party who facilitates both parties taking an active role in the process. Each party can have a lawyer on its side to look out for their interests as well.
